Acceptable Use Policy

1. Purpose

This Acceptable Use Policy (“AUP”) governs use of the MERIT Lumina and forms part of the Terms of Service. It sets out the standards of conduct we require from all users.

2. Permitted Use

The Platform may be used solely for:

  • Tracking, analysing, and reporting your organisation's KPIs and performance data
  • Managing NDIS-related service delivery metrics and compliance reporting
  • Internal business intelligence purposes by authorised staff
  • Any other purpose expressly authorised in writing by Merit Vision Pty Ltd

3. Prohibited Activities

You must not use the Platform to:

  • Upload, store, or transmit content that is unlawful, defamatory, harmful, or harassing
  • Violate any applicable law, regulation, or the rights of third parties
  • Conduct automated scraping, crawling, or bulk data extraction without written consent
  • Attempt to gain unauthorised access to the Platform or other users' accounts
  • Introduce malware, viruses, or other malicious code
  • Circumvent, disable, or interfere with security features of the Platform
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Use the Platform to compete directly with Merit Vision Pty Ltd without prior agreement
  • Share login credentials with individuals outside your authorised organisation
  • Upload personal information of NDIS participants beyond what is strictly required for Platform functionality

4. NDIS-Specific Obligations

Users who process data relating to NDIS participants must comply with all applicable requirements under the NDIS Act 2013, the NDIS Quality and Safeguards Framework, and the Australian Privacy Principles. You must not use the Platform to store or process sensitive NDIS participant information in a way that is inconsistent with those obligations.

5. Resource Usage

You must not use the Platform in ways that place unreasonable or disproportionate load on our infrastructure, including sending excessive API requests, uploading unusually large data files, or conducting load testing without prior written approval.

6. Reporting Violations

If you become aware of any misuse of the Platform, please report it immediately via our contact page.

7. Enforcement

Violation of this AUP may result in immediate suspension or termination of your account without refund. We reserve the right to report violations to relevant authorities where required by law.
